Higher Ground Switzerland Liability Waiver

By signing this document, you acknowledge that you have voluntarily chosen to participate in physical training activities at Higher Ground Switzerland.

This waiver and release of liability applies to any and all activities, classes, programs, events, or use of facilities provided by Higher Ground Switzerland.

1. Assumption of Risk

I am aware that participation in physical exercise involves inherent risks, including but not limited to accidents, injuries, illness, property damage, and even death. I knowingly and voluntarily assume full responsibility for these risks and any resulting injury or damage, whether caused by the negligence of Higher Ground Switzerland, its employees, contractors, or otherwise.

2. Release of Liability

I hereby release, waive, discharge, and covenant not to sue Higher Ground Switzerland, its affiliates, employees, agents, contractors, or instructors for any and all claims, demands, losses, or damages arising out of or in connection with participation in Higher Ground classes or activities, including those arising from negligence, except in cases of gross negligence or willful misconduct.

3. Health Declaration

I certify that I am in good health and physically fit to participate in Higher Ground activities. I understand that it is my responsibility to consult a physician prior to participation and that Higher Ground Switzerland is not responsible for any medical conditions or injuries resulting from my participation.

4. Communicable Diseases

I acknowledge the contagious nature of infectious diseases (including COVID-19) and voluntarily assume the risk of exposure or infection. I release

Higher Ground Switzerland from any claim arising from such exposure, except in cases of gross negligence or willful misconduct.

5. Equipment Use & Personal Responsibility

I am responsible for the safe and proper use of any equipment during classes or training sessions. I agree to immediately inform Higher Ground staff of any defects or unsafe conditions. Higher Ground Switzerland is not liable for damages or injuries resulting from improper or unauthorized equipment use.

6. Personal Property

I understand that Higher Ground Switzerland is not responsible for loss, theft, or damage to my personal belongings (including but not limited to mobile phones, clothing, or valuables) brought onto the premises.

7. Minors

Participants must be 18 years or older to sign this waiver. Minors may only participate with written consent of a parent or legal guardian, who also assumes all associated risks on behalf of the minor.

8. Data Protection & Media Use

I consent to the collection and processing of my personal data in accordance with Swiss Data Protection Law (FADP) and the EU GDPR. I also consent to the use of photos or videos taken during classes for promotional purposes by Higher Ground Switzerland.

9. Governing Law

This waiver is governed by Swiss law. Any disputes shall be subject to the exclusive jurisdiction of the courts in Zürich, Switzerland.

I have read this waiver carefully and understand its content. I voluntarily sign this document and acknowledge that it limits my legal rights.
